Welcome to WaveDyno. These Terms of Service ("Terms") govern your access to and use of the website located at wavedyno.com and the WaveDyno application located at app.wavedyno.com (together, the "Service"), operated by Havelaar US, LLC ("we," "us," or "our").
By accessing or using the Service, or by creating an account, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. The Service
WaveDyno is a browser-based simulation tool for internal-combustion-engine gas dynamics. The Service lets you configure engine models, run simulations on our infrastructure, and store, view, and compare the results.
WaveDyno is in active development. Features, models, and computed results may change between releases as the underlying physics models are improved and recalibrated.
2. Accounts
You must create an account to use the application. You agree to provide accurate registration information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.
3. Plans and Usage Limits
The Service offers a free plan subject to usage limits, including daily limits on simulation runs. We may grant selected users expanded or unlimited access, for example as part of a tester program, at our sole discretion, and we may modify or withdraw such access at any time.
We may change plan features, usage limits, and pricing as the Service evolves. We may also throttle, queue, or decline simulation runs to protect the stability of the Service.
4. Simulation Results Disclaimer
Simulation results produced by the Service are numerical estimates based on simplified physical models, calibration assumptions, and the inputs you provide. They are provided for informational and educational purposes only and do not constitute engineering advice.
- Results may differ substantially from the behavior of a real engine.
- You are solely responsible for independently verifying any design decision before building, modifying, or operating a real engine or component.
- Real engines and engine components can fail in ways that cause property damage, injury, or death. You assume all risk arising from your use of simulation results.
5. Your Content
You retain ownership of the engine configurations, projects, and other content you create in the Service ("User Content"). You grant us a limited license to host, store, process, and display your User Content solely as needed to operate and improve the Service. We may retain and analyze simulation inputs and results in aggregated or de-identified form to calibrate and improve our models.
6. Intellectual Property
All content, design, software, simulation models, computed reference data, text, graphics, and logos (including the WaveDyno name and brand marks) that make up the Service are the exclusive property of Havelaar US, LLC, and are protected by United States and international copyright, trademark, and intellectual property laws. Except for your own User Content, you may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
7. Acceptable Use
You agree to use the Service only for lawful purposes. You agree not to:
- Use the Service in any way that could damage, disable, overburden, or impair our servers or networks, including attempting to circumvent usage limits.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts or data, or any connected systems.
- Reverse engineer, scrape, or systematically extract the simulation models, solver behavior, or reference data underlying the Service.
- Resell or provide the Service to third parties as a service of your own without our written consent.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, or where reasonably necessary to protect the Service or other users. Upon termination we may delete your User Content after a reasonable period.
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Havelaar US, LLC makes no warranties, expressed or implied, regarding the availability, accuracy, or reliability of the Service or of any simulation results. We do not guarantee that the Service will be error-free or uninterrupted, or that stored projects and results will be preserved indefinitely.
10. Limitation of Liability
To the maximum extent permitted by law, Havelaar US, LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of the Service or your reliance on simulation results, even if we have been advised of the possibility of such damages. This includes, without limitation, damage to engines, vehicles, or other property, and personal injury, arising from decisions informed by the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will post the updated Terms on this page and update the date above. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
